Youtube flagging phantom videos on partner channels?

I have a yt partner account and my recent phantom uploads which are 100% my own content have been flagged quite randomly. On a technicality commercial useage of aerial videos is a bit of a questionable point but if we cant make money of such content what gives yt the right to put advertising on them and commercialize the same videos

It still makes no sense as they let the exact same videos pass in 3d and fail in 2d or the other way around.

Here are the last couple that have been flagged. The funny thing is both of these have an identical edit that passed as I made a 3D and 2D version of both and they are identical content other then the fact one is 2d and the other 3D.
