No quite. But no matter what software you will not be able to fly near any major airports. The update just makes it current. It's not the update that stops you but their so called geo fencing. I live 2 miles from a small airport and no problems flying there even though it says I'm in nfz. No fly zone.
But near our major airport. No way can I fly there. Nothing you can do about that. Update to keep aircraft safe. If near nfz. Drive to another location to fly. Hope this helps.

When you activate your Phantom, it doesn't update anything.
Firmware updates are something that only happens because you chose to do them.
The app may auto update, but only if you have your device set to auto-update.
