CAA - (c) within 50 metres of any vessel, vehicle

Am I right that:

(c) within 50 metres of any vessel, vehicle or structure which is not under the
control of the person in charge of the aircraft;

Does not prohibit flying OVER? Say for example 50m above a building not under my control?

The wording for congested areas says over or within whereas otherwise it’s just within?

Flying non-commercially of course.

Any help much appreciated

I think I get what your saying John, I've had a look at the pictures and I'm still not 100% myself. See below my highly technical cad drawing, is it A we have to stay 50m away in a kind of geofence or B. I've been sticking to A but would prefer it to be B.

I’m assuming your unrestricted subject must have notice of your flight?

Or to fly at point b on Ric’s cad, notice again given to the house....?

In your diagram, and I’m sure I read elsewhere, it is distance from uncontrolled buildings/people, which includes height. I.e. using Pythagoras theory etc. However, the lack of a clear horizontal limit. It’s hard to know wether 51m directly above a building, say flying over a house is all ok!
