That's not why he can't fly a UAS commercially. A commercial helicopter certificate is a perfectly valid pilot cert and definitely qualifies to allow one to fly a UAS commercially. But 333 exemptions also require that pilots be current. Currency requires that you have a valid flight review which pilots need to get every two years and requires flying with a flight instructor.The funny thing about this is that Peter Sachs who received the exemption can not fly his paper pane airplane commercially! He has a Helicopter/commercial rating and not any of the others listed (Private Pilot,Sport Pilot, etc) that are required to be PIC of a sUAS. Go figure!

That is what's ridiculous about the 333 thing. A guy who has many years of experience flying commercially and therefore knows a ton about commercial flight operations can't fly a UAV for money if he hasn't been inside an airplane for two years. But a guy who has a sport pilot certificate, and therefore knows nothing about flying commercially and arguably very little about flying recreationally can fly a UAV for money all he wants so long as he's current. Peter Sachs can probably teach the average sport pilot certificate holder more about flying in 10 minutes than they'll learn in year of flying on their own. But he can't be trusted to take photos for money with a UAV because he's not current. Its bull.
