Can't go higher than 120 meters

I guess I would have to ask you where it shows that under no circumstances can a hobbyist pilot fly above 120m to prove what I am assuming is your point.

If you are referring as a prevention mechanism in order to avoid hitting a building. I will ask you why you need to pass above such massive structure in the first place? The bottom line here is that no matter the circumstances... A hobbyest pilot can't go beyond 120 meters, if you do you are in violation of the FAA rules.

Not necessarily.

The height limit is AGL, which encompasses structures. You can also exceed it if you fly under a set of community based guidelines a la the AMA. Whether or not these things are smart to do, I will leave up to the reader - it's situational.
