Drone Footage in Political Ads

I live in Nashville, and there are many ads on right now for candidates running for mayor. I've noticed in a few of them obvious drone footage. (such as this one -

I'm curious what the FAA would say about this. Is this considered "commercial use"

First, how do you know the the Aerial Vid. Co. is not licensed?
You did not mention that.

It has been suggested on at least one Podcast I have listened to that the FAA will not bother with this stuff unless there is a complaint, a witness, and proof of what was used to capture the video.
Not saying it's wright/wrong, good/bad.
