I've not had it long and I've done about 10mins worth of flying. Its un useable pretty much, my Mavic is such a better drone imo!

Do you get the same problem with 2.4 and 5.8 GHz ? Or flying a few feet away?

Could be a production error. Either way, contacting DJI support would probably give you a replacement.

its set to auto i think, I haven't touched any of the settings but i'm going to take a look now. I bought it just after christmas, how long is their warranty for something like this?

Something definitely broken. Contact Dji for a replacement.

I cant do a restore on the controller either. I plug it into DJI assistant and it comes up with "unknown device"

This is why it's good to buy a DJI craft from a source with a 30 day exchange/return policy, so you can get a new replacement immediately instead of waiting 3wks for the DJI exchange. DJI's quality consistency is not good. The odds of getting a flawed craft are higher than normal for electronic products with similar complexity. I've had my share of returns for quality issues, new out of the box. However I love their products when they do work, totally awesome.
