So wait a second, this thing can record sounds underwater??? I'd like to see how that works out.

Underwater sound recording - that would be about as interesting/useful as sound recording on an electric drone.

Wow...that was interesting...glad I do not have any stock in GoPro. Have to wonder if GoPro could now sue the patent office for their mistake...as their mistake had such an adverse effect on their stock prices.

Are you kidding? Diving you hear some pretty cool noises. I'd love to catch some Orca vocalizations (or any of the whales that frequent our waters) here in the Puget Sound or up north where we have a little place in the San Juan's on the Salish Sea.
Or the mating call of the Midshipman's Fish:

Was just basing my opinion on years of scuba diving. Most of the time there's nothing to hear at all.
Get down on a reef and if you listen there are some random clicks every now and then or hear a diver's bubbles.

If you go to the 38 second point in this http://www.jimandsusan.com/fishing-trip-10-29-14.html video you can hear a dolphins echolocation as recorded from my GoPro 3. Pretty neat stuff.
