After contacting the http://www.ico.org.uk they have no issues about flying with cameras. Also the Metropolitan Police guidelines about recording in public is that it's perfectly legal even recording police officers exercising their duties.

In your video it definitely looks like the home point isn't set as you actually have control over the phantom when you move the controls (you just can't see it moving from the ground). When you pull back in HL mode the Phantom flies backwards exactly what it would do if the HL wasn't working...

Three blades increase speed but lower your battery life but it shouldn't be that low. Have you checked the actual battery voltage after each flight? Might be interesting to see what they are.
