We fly in some severe winds quite often , the drone flying in winds of 35 mph is acceptable but the Problem is not the drone its the Gimbal. 25 /30 Mph should be your cut off to protect the gimbal unless you are proficient at flying directly into the wind and back.

Yes we have called the FAA many many times and flying in the Rain or Capturing A storm is not included in Careless or Reckless Operations.. There are some regulations in regards to Storms but that is not one of them .

True, but its not Debatable and here is why anyone that owns a Mavic Air 2 that was stopped at 150 Ft was because they did not update the Battery Firmware,

We have found that the Battery can and does make a Difference in the behavior of the all the DJI drone not just the Phantom.
In the Phantom 4 having the wrong update can cause your Phantom to just take off , which is what the OP describes.
With the Mavic 2 Air not having the Right battery...
Check to make sure you Battery has the same updates as the drone , Since these are intelligent batteries they have
the ability to really effect how the Phantom 4 Flys, I say this because you purchased used so your probably in the dark on the battery updates.
