Jurisdiction: Railroad vs. FAA ... is this similar to National Parks

The LE officials who are IMO legally harassing you need to bring up chapter and verse of what they believe you were in violation of, the judge sounds like a knucklehead as well. There may be local laws or ordinances that play into this but I think the biggest factors is 1) you weren't fouling...

    H.R.302, Section 349 (US)

That page is just an overview - it isn't regulation. It could take months or years to put everything in that bill into the FARs, but many parts of 349 could happen within the next 180 days.

    H.R.302, Section 349 (US)

Good points but I think section 349 is very reasonable. Its what 336 should have been to begin with but it was quite evident that the people who put together 336 knew little to nothing about drones let alone aviation. It's simple: 1. Pass a safety test 2. Stay below 400' 3. Stay out of...

A quad copter can't but put up several global hawks dedicated to a continual search and I'd say it's very do-able!

    H.R.302, Section 349 (US)

Remember, this isn't law yet. It still has to go through the Senate and get approved by the president. I believe there is funding in this bill so more than likely it will get pushed through before Oct. I which is when the fiscal year begins.

Geo Fencing, beating a dead dog?

Depending where you are in the country some towers will give authorization under 107.41 but I do know the FAA put out a policy directing ATC facilities to do otherwise, but as stated with LAANC in place the need to contact the tower is eliminated.

This is exactly what this bill says with regards to hobbyists; 44809. Exception for limited recreational operations of unmanned aircraft (a) IN GENERAL.—Except as provided in subsection (e), and notwithstanding chapter 447 of title 49, United States Code, a person may operate a small unmanned...

It doesn't say that. P284 " In Class G airspace, the aircraft is flown from the surface to not more than 400 feet above ground level and complies with all airspace restrictions and prohibitions." While I believe you are correct about this bill not changing the way people fly, at least it...

This bill started in 2017, it was just approved in congress. House Clears FAA Bill Once More, Along with Extension Did you read past page 282? Hobbyists will have to take a safety test, get authorization to fly in airport controlled B, C, D and E airspace and will be limited to 400' AGL. Now...

Agree 100% Al! I do think that the waiver process is a given. When this bill passes I think any changes in the FARs to implement these new laws will still have to go through a Notice of Proposed Rule Making process. I bet this will be brought up then with the FAA pointing to the waiver...
